If you went to see students in Grade 6 do Math, you would never see any of them only Add and never Subtract. 

if you asked them to determine what 8% of a sum  was they would first add and subtract what was needed BEFORE getting 8% of that value.

Well probate attorneys would fail any grade 6 Math class because they can only add an estates assets they cannot subtract its liabilities.

So if you had a $500,000 home with a $400,000 mortgage and you were told that the probate fees would only be 8% it is 8% of $500,000 or $40,000 which is 40% of the real net worth of $100,000 ($500,000 - $400,000).
